Terms & Conditions

1. DEFINITIONS

  • The Platform: Hola Hola Tours, located at Klaverkamp 54, 4133TK Vianen, The Netherlands (KvK: 93615027), acting as an intermediary booking agent.

  • The Operator: The third-party service provider responsible for the actual execution of the tour or activity. The specific Operator is listed in the tour details at the time of booking.

  • The Client: The individual or entity making a reservation through the Platform.

 

2. SCOPE OF SERVICE

Hola Hola Tours operates as a digital marketplace for Nicaraguan tourism services. We provide a platform where various tours are aggregated to assist the Client in making informed travel choices. Important: Hola Hola Tours is a booking agent (intermediary) and not the executor of the tours. The legal contract for the execution of the tour is between the Client and the Operator.

 

3. PAYMENTS & CURRENCY
Payment Models: Depending on the selected Operator, two payment models apply:

  • Standard Model (Deposit): A reservation fee (deposit) is paid to the Platform to secure the booking, with the remaining balance due directly to the Operator on the day of the tour.

  • Full Payment Model: For selected services, the full amount is processed securely through the Platform, and no further payment is required on the day of the tour. The applicable payment model is clearly indicated during the checkout process for each specific service.

 

4. CANCELLATIONS & REFUNDS

  • General Rule: Deposits are generally non-refundable as they cover the administrative and platform costs of securing the reservation.

  • Flexibility: Hola Hola Tours strives for excellent customer relationships. In case of valid, well-founded reasons for cancellation, the Client may contact us via WhatsApp to discuss a potential solution or rescheduling.

  • Operator Cancellation: If a tour is cancelled by the Operator (e.g., due to safety or weather), the Platform will assist in rescheduling or, if impossible, refunding the deposit.

  • No-Show: In the event of a no-show, the deposit is forfeited. The Operator reserves the right to claim the remaining balance in accordance with their own terms.

5. LIABILITY & INSURANCE

  • Execution: The Operator is solely responsible for the safety, quality, and execution of the tour.

  • Disclaimer: Hola Hola Tours is not liable for any accidents, injuries, illnesses, delays, or loss of personal property occurring during or in relation to the tour.

  • Insurance: It is the sole responsibility of the Client to maintain adequate travel, medical, and accident insurance. By booking, the Client confirms they are physically fit for the chosen activity.

 

6. PRIVACY & MEDIA

The Client acknowledges that Operators may take photographs or videos during tours for promotional purposes. Unless the Client explicitly objects to the tour guide before the start of the activity, these materials may be shared on social media by the Operator or the Platform.

 

7. CHANGES TO TERMS

Hola Hola Tours reserves the right to modify these terms. The terms applicable at the time of booking will prevail.

 

8. GOVERNING LAW

This Agreement and the relationship between the Client and the Platform are governed exclusively by the laws of the Netherlands. Any disputes shall be submitted to the competent courts in the Netherlands.
